1. Introduction

Welcome to Orcred, a technical verification platform operated by Orcred Technologies Private Limited (“Orcred”, “Company”, “we”, “us” or “our”).

This Disclaimer Policy (“Disclaimer”) applies to your access to and use of the Orcred websites at orcred.com and dashboard.orcred.com, public credential pages, platform, verification services, Sessions, Orcred Scores, Credentials and related services (collectively, the “Platform”).

By accessing or using the Platform, you acknowledge and agree to the disclaimers set out below. This Disclaimer applies to Candidates and also to employers, recruiters, institutions and anyone else who views or relies on an Orcred Score or Credential. This Disclaimer shall be read together with Orcred’s Terms of Use, Privacy Policy, Payment and Refund Policy (when payments are enabled on the Platform), and other applicable policies governing your use of the Platform. Capitalised terms used but not defined in this Disclaimer have the meanings given to them in the Terms of Use.

2. Nature of the Platform

a)

Orcred provides a technical verification platform intended to facilitate the assessment of a Candidate’s demonstrated understanding of a submitted project through live technical review Sessions conducted by independent technical Reviewers.

b)

The Platform is intended to provide a verification and assessment mechanism based on the information, materials and responses provided by the Candidate during the applicable verification process.

c)

Orcred does not represent or warrant that participation in the verification process, obtaining an Orcred Score, or receiving a Credential will result in employment, recruitment, admission, promotion, compensation, investment, business opportunities or any other specific outcome.

3. No Guarantee of Employment or Other Outcome

a)

An Orcred Score or Credential is not an offer, recommendation, certification of employment readiness, professional licence, academic qualification, or guarantee of employment.

b)

While an Orcred Credential may be used by a Candidate to demonstrate completion of Orcred’s verification process, Orcred does not guarantee that any employer, recruiter, institution, client or other third party will recognise, rely upon, or accept such Credential.

c)

Any decision relating to employment, recruitment, engagement, compensation, admission or other opportunity remains solely with the relevant third party.

4. Nature and Limitations of Assessment

a)

The verification process is based on the Candidate’s project submission, information provided by the Candidate, performance during the applicable Session, and Orcred’s assessment framework.

b)

An Orcred Score reflects the outcome of the applicable verification process and should not be interpreted as an absolute or comprehensive representation of the Candidate’s overall technical ability, professional experience, future performance or suitability for a particular role or opportunity.

c)

Technical assessments necessarily involve a degree of professional judgment. Accordingly, Orcred does not warrant that every assessment or Score will be identical to an assessment that may be conducted by another individual, organisation or methodology.

5. Reviewer Independence

a)

Review Sessions are conducted by technical Reviewers engaged by Orcred as independent contractors.

b)

While Orcred may establish assessment standards, procedures and quality-control mechanisms, individual assessments may involve the professional judgment of the assigned Reviewer. Orcred does not guarantee that a Reviewer’s assessment will be free from error, disagreement or subjective judgment.

c)

Orcred reserves the right to take appropriate quality-control or corrective measures where it identifies a material issue affecting the integrity of a Session or Credential.

6. Accuracy of Candidate Information

a)

Orcred relies, in part, on information, representations, project materials and declarations provided by Candidates.

b)

Orcred does not independently guarantee the accuracy, completeness, authenticity or ownership of every statement, project, code, document or other material submitted by a Candidate.

c)

Candidates are solely responsible for ensuring that the information and materials submitted to Orcred are accurate, complete, lawful and genuinely attributable to them.

d)

Any fraudulent, misleading, plagiarised or unauthorised submission may result in rejection, disqualification, Credential revocation, suspension or other action in accordance with the Terms of Use and Applicable Laws.

7. Orcred Score and Credential

a)

The issuance of an Orcred Score or Credential is subject to the applicable verification requirements and assessment process.

b)

An Orcred Score or Credential does not constitute a guarantee that the Candidate possesses any particular level of technical proficiency beyond what is assessed through the applicable verification process.

c)

Orcred reserves the right to suspend, invalidate or revoke a Credential where fraud, misrepresentation, breach of the Terms of Use, manipulation of the verification process or any other material irregularity is identified.

d)

The Orcred Score and Credential relate solely to the specific project submitted by the Candidate for the applicable verification process. They do not constitute a representation regarding the Candidate's overall engineering ability, work ethic, character or suitability for any role beyond what was assessed during the specific verification Session.

8. Platform Availability

a)

Orcred endeavours to maintain the availability and functionality of the Platform. However, the Platform may from time to time be unavailable, interrupted, delayed or affected by technical issues, maintenance, connectivity problems, third-party service failures or circumstances beyond Orcred’s reasonable control.

b)

Accordingly, Orcred does not warrant that the Platform or any particular feature or functionality will always be available, uninterrupted, secure, error-free or free from technical defects.

9. Third-Party Services

a)

The Platform may use or integrate with third-party services, including payment gateways, communication tools, hosting providers, authentication services and other technology providers.

b)

Orcred does not control and is not responsible for the availability, performance, security, policies or practices of such third-party services. Your use of any third-party service may be subject to the terms and policies of the relevant third party.

10. Candidate Project Materials

a)

Candidates retain ownership of their intellectual property in their project submissions, subject to the rights and permissions expressly provided to Orcred under the applicable Terms of Use.

b)

Orcred does not represent or warrant that participation in the verification process will protect a Candidate’s project, code, ideas, trade secrets or other intellectual property against unauthorised disclosure or use by persons other than Orcred.

c)

Candidates are responsible for ensuring that they have the necessary rights and permissions to submit their project materials and should avoid submitting confidential information belonging to third parties without appropriate authorisation.

12. No Warranty

a)

To the maximum extent permitted under Applicable Laws, the Platform and its content, Services, assessment processes, Scores and Credentials are provided on an “as is” and “as available” basis.

b)

Orcred disclaims all warranties, representations and conditions, whether express, implied or statutory, to the extent legally permissible, including warranties relating to accuracy, reliability, availability, fitness for a particular purpose, non-infringement and uninterrupted operation.

c)

Nothing in this Disclaimer shall exclude or limit any liability or right that cannot lawfully be excluded or limited under Applicable Laws.

13. Limitation of Reliance

a)

Users and third parties should exercise their own judgment before relying upon any information, Score, Credential, assessment outcome or other material available through the Platform.

b)

Orcred shall not be responsible for any decision made by a Candidate, employer, recruiter, institution or other third party solely or substantially on the basis of an Orcred Score, Credential or information available through the Platform, except to the extent such liability cannot be excluded under Applicable Laws.

14. Changes to this Disclaimer

Orcred may update or modify this Disclaimer from time to time to reflect changes in the Platform, its Services, Applicable Laws or operational practices.

The updated version shall be published on the Platform with the revised “Last Updated” date. Your continued use of the Platform following such update shall constitute your acknowledgement of the revised Disclaimer, to the extent permitted by Applicable Laws.
